Marcus J. Green is experienced in complex civil litigation and domestic and international arbitration. Mr. Green also regularly conducts internal investigations and advises clients in connection with criminal and regulatory investigations.

 

Recent Engagements:

  • Representation of Pankesh Patel in the highly-publicized, eight week long "FCPA sting" trial in Washington DC. Mr. Green was part of the trial team that obtained a novel ruling in the client's favor regarding the limits of U.S. jurisdiction under the FCPA. The Kobre & Kim team went on to secure a judgment of acquittal in favor of Mr. Patel on an alleged substantive violation of the act and a charge that he conspired to launder money, while also obtaining a mistrial from the Court as to the remaining two charges against Mr. Patel.
  • Representation of an Asia-Pacific sovereign entity in enforcing judgments of more than US $90 million against assets and defendants in multiple jurisdictions in the United States, the Caribbean, and Asia
  • Representation of the board of directors of an international natural resources company in conducting an internal investigation over alleged FCPA violations and the World Bank sanctions regime
  • Representation of an officer of an international engineering consulting firm in responding to an investigation being conducted by the U.S. Department of Justice and the U.S. Securities and Exchange Commission into possible FCPA violations
  • Representation of an institutional LLC member in joint venture dispute against a private equity firm /co-LLC member involving a contest for control over a substantial business in the nightclub and gaming industry, involving litigations in New York and Nevada
  • Representation of an individual in response to a Congressional subpoena relating to military fuel contracting practices in Central Asia
  • Representation in connection with multiple litigations in the New York and Florida state and federal courts, and the U.S. Bankruptcy Court for the Southern District of Florida, arising from an alleged breach of a joint venture agreement regarding several real estate investments, involving more than US $50 million in controversy

Prior To Kobre & Kim LLP:

Prior to joining Kobre & Kim, Mr. Green practiced with Cravath, Swaine & Moore LLP in New York and with Greenberg Traurig LLP in Miami, representing clients in commercial and securities litigation, international arbitrations and in connection with criminal and regulatory matters.

Prior to law school, Mr. Green was a manager, contract negotiator, and industrial engineer for transportation and logistics concerns.
