Tim Prudhoe is an experienced civil and commercial litigator with extensive experience in relation to offshore financial centres (also known as 'tax havens'). He undertakes work both in the courts of England as well as overseas. With almost a decade spent working offshore, his unique combination of onshore and offshore trial experience is especially suited to multi-jurisdictional disputes.
He is also a Fellow of the Chartered Institute of Arbitrators and an experienced arbitration practitioner.
Recent Engagements:
Offshore Trusts & Asset Forfeiture/Recovery:
- Representation of a government entity in enforcing judgments worth US $100 million against assets and debtors in various countries
- Representation of a partner in an offshore LLP in connection with an alleged forfeit of partnership interests arising out of admitted misappropriations, involving US $500 million in controversy
- Representation of a Vice President at an investment bank in connection with a successful jurisdictional challenge (Turks & Caicos Islands / New Jersey), leading to the largest settlement of its kind in the history of New Jersey
- Representation of the principal beneficiary of an offshore trust with regards to contested issues of trustee disclosure and use of trust assets in respect of London High Court Chancery Division trial
Commercial Litigation and Arbitrations:
- Representation of a high technology reseller company in the Middle East against a U.S. company in ICC arbitration proceedings in London arising from allegations of unfair competition, involving more than £70 million in controversy
- Representation of a majority shareholder accused of deceit and fraud in respect of share sale
- Representation of a shareholder in a British Virgin Islands company in connection with an arbitration concerning the valuation of shares on forced departure
- Representation of entities and individuals in defending against a claim brought by the Attorney-General of the Turks & Caicos Islands for alleged underpayment of stamp duty in respect of a large property in the Turks & Caicos, British West Indies
Financial Products & Services Litigation:
- Representation of U.S. hedge funds in municipal bond arbitrage litigation against investment bank in England regarding breach of contract arising of investment agreements, involving more than £30 million in controversy
Insolvency & Debtor-Creditor Disputes:
- Representation of hedge fund administrators in connection with insolvent offshore "feeder" funds involving the more than US $50 billion "Ponzi Scheme" associated with Bernard Madoff
Government Enforcement Defense:
- Representation of corporate entity alleged to have bribed high-ranking officials in the Caribbean in combined U.S. Department of Justice and Turks and Caicos Island Special Prosecutions matter
- Representation of a securities brokerage firm in connection with allegations by the U.S. Securities and Exchange Commission of unlawful trading in restricted stock and issues of non-US confidentiality legislation
- Representation of the former-Premier's estranged wife before the Turks & Caicos Islands Commission of Inquiry regarding allegations of endemic governmental corruption, nepotism and criminal financial mismanagement
- Representation of a principal of a broker/dealer firm accused of insider trading, including representation before the Ontario Securities Commission (Canada)
Prior To Kobre & Kim LLP:
Tim Prudhoe was called as a Barrister in 1994. Before joining Kobre & Kim LLP, Mr. Prudhoe was based in the Caribbean where his work spanned the major offshore financial centres. He was then a member of Enterprise Chambers, 9 Old Square, London representing clients across a wide range of jurisdictions in disputes involving contentious insolvency, civil and commercial litigation and arbitral disputes relating to the fiduciary and financial services industries.
