Zaharah R. Markoe focuses in the areas of government enforcement defense and internal investigations, with particular emphasis on securities-related litigation and investment manager and broker-dealer regulation. Ms. Markoe also practices complex civil litigation, focusing on appellate advocacy.

 

Recent Engagements:

  • Representation of Brian Hunter, the former Head of Energy Trading at Amaranth Advisors, in litigation against the FERC and the CFTC over alleged improper trading of natural gas futures contracts
  • Representation of an execution broker in NFA arbitration brought by a customer relating to alleged manipulation of metal futures markets.  The firm successfully argued for dismissal of its client from the arbitration in a preliminary hearing.
  • Representation of an institutional client in connection with a dispute of breaches of representations and warranties in PSA and MLPA in a securitization worth over US $1 billion
  • Representation of an execution broker as a defendant in a potential CFTC enforcement action and a related class action relating to alleged attempted manipulation of the NYMEX platinum and palladium futures markets. 
  • Representation of an individual in connection with an investigation conducted by the Antitrust Division of the U.S. Department of Justice
  • Representation of a large public company in the airline industry in connection with the U.S. Department of Justice investigation into alleged price-fixing in air cargo surcharges
  • Representation of a financier in connection with civil litigation in the U.S. District Court for the Southern District of Florida arising from alleged breach of a joint venture agreement
  • Representation of a FINRA member firm in a multi-million dollar arbitration involving various securities-related civil claims resulting in complete victory at hearing
  • Representation of former executives of Bank of America Securities in high-profile mutual fund industry investigations conducted by the New York State Attorney General's Office and related civil class and derivative actions
  • Representation of a large Wall Street investment bank in an industry-wide securities inquiry into issues relating to certain fixed income securities conducted by the U.S. Securities and Exchange Commission
  • Representation of the senior management of a publicly-held European media company in conducting an internal investigation into allegations of accounting fraud
  • Representation of a former hedge fund manager in an investigation by the U.S. Attorney's Office for the Southern District of New York and the U.S. Securities and Exchange Commission
  • Representation of an investment banking group of a large investment bank in multi-million dollar federal lawsuit involving alleged theft of trade secrets and confidential information
  • Representation of a Hong Kong corporation in an appeal of a matter relating to a banking dispute under the Uniform Commercial Code

Prior to joining Kobre & Kim, Ms. Markoe served as an Assistant District Attorney in the Bronx County District Attorney's Office, where she focused on criminal appeals involving a wide variety of subject matters.
