Kobre & Kim Case Concerning Spain’s Sovereign Immunity and Investment Treaty Arbitration Featured by The Lawyer Among Top 2024 Appeals

The Kingdom of Spain’s appeal against a landmark English High Court judgment in favor of two investors represented by Kobre & Kim is featured among the top ten appeals of 2024 by The Lawyer.

In May 2023, the High Court dismissed Spain’s application to set aside the registration in England of a €120 million ICSID arbitration award under the Energy Charter Treaty on grounds of state immunity and the Court of Justice of the European Union’s decisions in the cases of Achmea and Komstroy. Spain has been granted permission to appeal, and the case will be heard before the Court of Appeal in June 2024.

The claimant investors are represented by Henderson Chambers’ Patrick Green KC, and Kobre & Kim’s Andrew Stafford KC and Richard Clarke.
